Registration of Slogans

A slogan is understood to be a word, phrase or caption used as in addition to a brand to strengthen its distinctiveness. Some examples of famous advertising slogans are: “I’m lovin’ it" (McDonald’s); "Just do it" (Nike); "Always" (Coca-Cola); "The choice of a new generation" (Pepsi); "Think different" (Apple) or "La nuestra" (Colombiana).

To get the exclusive right to the use of a slogan it must be registered with the Superintendent’s Office of Industry and Trade.

The validity of an advertising slogan is subject to the mark with which it is associated.

The applicable standard in Colombia requires that commercial slogans are not banal expressions, common or descriptive and dictates they must have sufficient distinctiveness to identify a particular commercial origin. That is, they must be clever and attractive words or phrases.
